Terms of Service & End User License Agreement

These Terms of Service and End User License Agreement (the "Terms") govern your use of the HypeDrive Twitch Extension, the HypeDrive streamer desktop app, and the HypeDrive website (together, the "Service"), provided by HypeDrive ("HypeDrive", "we", "us"). By using the Service you agree to these Terms. HypeDrive is not affiliated with, endorsed by, or sponsored by Twitch Interactive, Inc.
Eligibility
You may use the Service only if you are permitted to use Twitch under Twitch's terms and are legally able to agree to these Terms. If you use HypeDrive for a channel or organization, you confirm that you have authority to act for it.
License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, reverse engineer, resell, or distribute the Service except as permitted by applicable law.
Twitch and Bits
HypeDrive runs on Twitch and uses Twitch Bits to activate defined digital experiences such as Hype Drops. Bits are Twitch digital content, not currency or a money instrument. Twitch processes Bits exchanges, not HypeDrive. Your use of Twitch and Bits is governed by Twitch's terms, policies, and applicable refund rules. HypeDrive cannot issue Bits refunds.
Acceptable use
- Do not use the Service for any unlawful, abusive, or fraudulent purpose.
- Do not attempt to disrupt, overload, or gain unauthorized access to the Service.
- Do not use the Service to harass others or to send unlawful or infringing content.
User content
You are responsible for content you submit through the Service, including messages attached to Hype Drops. You must have the rights to that content, and it must comply with these Terms and Twitch's policies. You grant HypeDrive a limited, worldwide, non-exclusive, royalty-free license to process, moderate, display, broadcast, and reproduce that content only as needed to operate and promote the submitted Hype Drop within the Service and its connected Twitch channel.
Approved display names, Bits amounts, and messages may appear publicly in the channel overlay, mobile panel, leaderboard, and Twitch chat. HypeDrive and the streamer may filter, reject, hide, or remove content. Identity sharing may be required before you can submit a message.
Third-party services
The Service depends on Twitch and may use service providers for hosting, analytics, and website form delivery. Their services are governed by their own terms and may be unavailable or changed independently of HypeDrive.
Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error free.
Limitation of liability
To the maximum extent permitted by law, HypeDrive will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or Bits, arising from your use of the Service.
Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service. You may stop using the Service at any time.
Changes
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. Courts located in Israel will have jurisdiction, subject to any mandatory rights or venue available to you under applicable consumer law.
